1. Acceptance of Terms

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User”, “you”, or “your”) and TrustSaathi (“Company”, “we”, “our”, or “us”) governing your access to and use of the TrustSaathi platform, website, applications, and related services (collectively, the “Platform”).

By accessing or using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Platform.

2. Nature and Scope of Services

TrustSaathi provides digital verification services including:

  • Identity validation through consent-based authentication mechanisms;
  • Structured screening of publicly available court records;
  • Generation of verification summaries and reports.

TrustSaathi does not:

  • Conduct private investigations;
  • Access confidential police databases;
  • Provide legal advice;
  • Offer guarantees regarding the character, conduct, or future actions of any individual.

The services are informational in nature and are designed to reduce uncertainty, not eliminate risk.

3. Consent-Based Verification Requirement

TrustSaathi operates strictly on a consent-based verification model.

Verification may only be initiated where:

  • The individual being verified is aware of the request;
  • OTP-based authentication is completed;
  • Active participation (including live photo capture, where applicable) is provided.

Unauthorized attempts to conduct verification without consent are strictly prohibited and may result in immediate suspension, termination, and potential legal action.

4. Eligibility

You represent and warrant that:

  • You are at least 18 years of age;
  • You have the legal capacity to enter into a binding agreement;
  • You will use the Platform only for lawful purposes;
  • You will not misuse or misrepresent verification results.

5. User Responsibilities

You agree that you shall:

  • Provide accurate and truthful information;
  • Not attempt to bypass authentication mechanisms;
  • Not use verification reports for harassment, discrimination, coercion, or defamation;
  • Not publicly distribute verification reports without lawful justification and consent;
  • Comply with all applicable laws while using the Platform.

You acknowledge that misuse of verification data may expose you to civil or criminal liability under applicable law.

6. Accuracy and Limitations of Information

Verification reports are generated based on publicly available court records and authentication responses available at the time of processing.

TrustSaathi does not warrant or guarantee:

  • The completeness or accuracy of third-party public records;
  • That court databases are updated in real time;
  • That absence of records implies absence of legal history;
  • Any future conduct, behavior, or legal status of an individual.

The Platform provides structured access to existing public information and authentication outcomes only.

7. No Professional Advice

The services provided by TrustSaathi do not constitute legal, financial, employment, matrimonial, or investigative advice. Users are solely responsible for making independent decisions based on verification reports.

8. Fees and Payment

Certain services require payment of a one-time verification fee.

All payments:

  • Are processed through authorized payment gateways;
  • Are subject to applicable taxes, including GST;
  • Are non-refundable once the verification process has commenced.

TrustSaathi reserves the right to modify pricing at its discretion, with updated pricing displayed on the Platform.

9. Intellectual Property

All content, branding, logos, software, and design elements of the Platform are the intellectual property of TrustSaathi or its licensors.

Users are granted a limited, non-transferable, non-exclusive license to access and use the Platform for personal, lawful purposes only.

No part of the Platform may be copied, reproduced, reverse engineered, or commercially exploited without prior written permission.

10. Data Protection and Privacy

Personal data is processed in accordance with our Privacy Policy and Data Retention Policy.

By using the Platform, you acknowledge that:

  • Data processing is consent-driven;
  • Certain records are retained for compliance and dispute resolution;
  • TrustSaathi implements reasonable security safeguards, but no system is completely immune to risk.

11. Suspension and Termination

TrustSaathi reserves the right to suspend or terminate access to the Platform where:

  • These Terms are violated;
  • Fraudulent activity is suspected;
  • Unauthorized verification attempts occur;
  • Required by law or regulatory direction.

Termination does not relieve Users of obligations incurred prior to termination.

12. Limitation of Liability

To the maximum extent permitted under applicable law, TrustSaathi shall not be liable for:

  • Decisions made by Users based on verification reports;
  • Indirect, incidental, consequential, or punitive damages;
  • Errors originating from public databases or third-party systems;
  • Delays caused by external authentication services;
  • Loss of opportunity, reputation, or business.

In no event shall the total liability of TrustSaathi exceed the amount paid by the User for the specific verification service giving rise to the claim.

13. Indemnification

You agree to indemnify and hold harmless TrustSaathi, its directors, officers, employees, and affiliates from any claims, damages, liabilities, costs, or expenses arising from:

  • Misuse of the Platform;
  • Violation of these Terms;
  • Unlawful use of verification reports;
  • Infringement of third-party rights.

14. Force Majeure

TrustSaathi shall not be liable for failure or delay in performance resulting from events beyond reasonable control, including but not limited to natural disasters, internet outages, governmental actions, or system failures.

15. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India.

Subject to applicable dispute resolution provisions, courts located in [Insert City] shall have exclusive jurisdiction.

16. Dispute Resolution

In the event of any dispute arising out of or relating to these Terms, the parties shall first attempt amicable resolution.
